COURT SILENT IN DISPUTE OVER SHOREHAM EMERGENCY PLAN.(Local)

New York's Court of Appeals chose not to take a stand Wednesday in the Cuomo administration's controversial efforts to block the Shoreham nuclear power plant from opening.

The court, the state's highest, refused to issue an advisory ruling on whether New York laws allow Shoreham's owners, the Long Island Lighting Co., to implement an emergency plan without state and Suffolk County participation.

An approved evacuation plan must be in place before the plant can receive a federal license to operate.

"The courts of New York do not issue advisory opinions," wrote Chief Judge Sol Wachtler for his six fellow judges. …
